Terms of use

Last updated 26 October 2026

These terms are an agreement between you and Kaiku Labs ([COMPANY LEGAL NAME], [REGISTERED ADDRESS]), the makers of Talkr (“we”, “us”). They cover your use of the Talkr app and this website, and they’re also the licence agreement (EULA) for the app on the App Store. By creating an account or using Talkr, you agree to them. If you don’t agree, please don’t use Talkr.

Our privacy policy explains how we handle your data.

1. Who can use Talkr

You must be at least 16 to use Talkr. You need a Google or Apple account to sign in, and you’re responsible for keeping access to it secure.

2. What Talkr does

Talkr gives you topics to talk about, records what you say, and uses automated tools, including AI models run by our providers, to give you a score and tips on how to improve.

The feedback is automated. It can be wrong or incomplete, and it isn’t professional advice (for example, it’s not speech therapy, career or language-teaching advice). Use it as a practice aid and use your own judgement.

We’re always improving Talkr, so features may change, and we may add, change or remove topics and features at any time.

3. Your content

You own what you say and the transcripts of it (“your content”). You give us permission to process your content only to run Talkr for you: to transcribe and analyse your recordings, save your results to your account and show them to you, and to check and improve the quality of Talkr’s feedback, as described in our privacy policy. This permission ends when you delete your content or your account, except for what’s already in short-lived backups.

Please don’t record other people without their permission, and don’t include sensitive personal information about others in your sessions.

4. Using Talkr fairly

You agree not to:

  • break the law, or infringe anyone else’s rights, while using Talkr
  • try to access other people’s accounts or data, or our systems, without permission
  • interfere with or overload Talkr, or get around its limits or security
  • copy, resell, reverse-engineer or build a competing service from Talkr, except where the law allows it
  • use Talkr to create content that’s abusive, hateful or harmful

We may suspend or close accounts that break these terms.

5. Prices and purchases

Some or all of Talkr may be free. If we offer paid features or subscriptions, the price and what you get will be shown in the app before you buy. Purchases are made through Apple’s App Store and are processed by Apple under its terms. Subscriptions renew automatically until you cancel them in your Apple ID settings, at least 24 hours before the end of the current period. Refunds are handled by Apple under its policies.

6. Our app and licence

Talkr, its design, topics and software belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the Talkr app on Apple devices you own or control, as allowed by the App Store’s Usage Rules, for your own non-commercial use.

7. Ending your use

You can stop using Talkr at any time and ask us to delete your account (see our privacy policy). We may stop offering Talkr or end your access if you break these terms, or if we have to for legal or security reasons. Where we reasonably can, we’ll give you notice first.

8. Disclaimers

We work hard to keep Talkr working well, but we provide it “as is” and “as available”. As far as the law allows, we don’t promise that Talkr will always be available, error-free, or that its feedback will be accurate or improve your speaking.

9. Our responsibility to you

Nothing in these terms limits or excludes our liability where the law doesn’t allow it, including for death or personal injury caused by our negligence, or for fraud. Nothing in these terms affects your statutory rights as a consumer.

Otherwise, as far as the law allows, we’re not responsible for losses that weren’t foreseeable, for business losses, or for losses caused by things outside our reasonable control. Our total liability to you for any claim is limited to the greater of the amount you paid us for Talkr in the 12 months before the claim, or £50.

10. Apple

If you got Talkr from Apple’s App Store:

  • These terms are between you and us, not Apple. We, not Apple, are solely responsible for Talkr and its content.
  • Apple has no obligation to provide any maintenance or support for Talkr.
  • If Talkr fails to meet any applicable warranty, you can tell Apple, and Apple will refund the purchase price you paid for it, if any. As far as the law allows, Apple has no other warranty obligation for Talkr. Any other claims, losses or costs from a failure to meet a warranty are our responsibility, as set out in these terms.
  • We, not Apple, are responsible for handling any claims you or anyone else make about Talkr, including product liability claims, claims that Talkr doesn’t meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If anyone claims that Talkr or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and resolving the claim.
  • You confirm that you’re not in a country subject to a US government embargo or designated as “terrorist supporting”, and that you’re not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.

11. Changes to these terms

We may update these terms from time to time. If we make significant changes, we’ll update the date at the top and, where appropriate, let you know in the app before they take effect. If you keep using Talkr after that, the new terms apply.

12. Law and disputes

These terms are governed by the laws of [GOVERNING LAW]. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring claims in your local courts.
